A Manhattan jury deadlocked Friday on the rape charge against Harvey Weinstein, forcing Judge Curtis Farber to declare a mistrial in the former Hollywood producer’s third trial on the allegation, according to the Associated Press.

Jurors sent a note saying they “have concluded that they cannot reach” a unanimous verdict on their third day of deliberations. Farber instructed them to keep deliberating before ultimately declaring the mistrial.
The outcome is a significant setback for prosecutors, but the case is not over. A hearing is set for June 24, where District Attorney Alvin Bragg will decide whether to pursue a fourth trial. Bragg said he was “disappointed” but would consult with Mann before making that call.
The charge has a complicated history: Weinstein was convicted on it in 2020, an appeals court threw out that verdict, and a 2025 retrial also ended without a verdict. Weinstein remains incarcerated on separate sex crime convictions in New York and Los Angeles.
